TERMS AND CONDITIONS

These Terms and Conditions ("Terms") constitute a binding legal agreement between you ("you" or "User") and FixLancers, LLC ("FixLancers," "we," "us," or "our"). By accessing or using the FixLancers platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. FIXLANCERS PLATFORM

FixLancers is a marketplace platform that connects customers with independent service providers ("Professionals"). FixLancers does not employ, supervise, or control these Professionals, and does not warrant their work, conduct, or qualifications.

YOU ACKNOWLEDGE THAT FIXLANCERS IS NOT A PARTY TO ANY CONTRACT FORMED BETWEEN CUSTOMERS AND PROFESSIONALS. ALL SERVICES ARE RENDERED BY THIRD PARTIES.

2. USER ELIGIBILITY

You must be at least 18 years of age and capable of entering into a legally binding contract to use this platform.

3. ACCOUNT RESPONSIBILITIES

You are responsible for all activities conducted through your account. You agree not to:

Impersonate others
Use the platform for unlawful or fraudulent purposes
Circumvent platform systems or payment processes

4. PAYMENT & FEES

Payments are processed through third-party payment providers (e.g., Stripe)
FixLancers may charge a platform fee, transaction fee, or commission
Professionals are solely responsible for the services provided, including refunds, reschedules, and disputes

5. NO GUARANTEE OR WARRANTY

FixLancers makes no representations or warranties regarding:

The identity, suitability, quality, or legality of any Professional or service
The outcome, performance, or timing of any service
User-generated content or ratings

YOU USE THE PLATFORM AND ENGAGE SERVICES AT YOUR OWN RISK.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, FixLancers, LLC, its officers, directors, employees, affiliates, licensors, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, goodwill, use, data, or other intangible losses, even if advised of the possibility of such damages.

In no event shall FixLancers’ total aggregate liability for any claims arising out of or relating to these terms, the platform, or services provided through the platform exceed fifty U.S. dollars ($50.00), regardless of the nature of the claim or the number of claims made.

You agree that this limitation shall apply to the fullest extent permitted by law, regardless of the form of action—whether in contract, tort (including negligence), strict liability, or otherwise.

7. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless FixLancers, its affiliates, officers, directors, employees, and agents from any claim or demand arising out of:

Your use of the platform
Your violation of these Terms
Your relationship or dispute with a Professional

8. TERMINATION

We may suspend or terminate your access at any time, with or without cause or notice. Provisions regarding limitation of liability, indemnity, and intellectual property survive termination.

9. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws principles.

Any disputes shall be resolved through binding arbitration in Phoenix, Arizona, under the rules of the American Arbitration Association. You waive the right to participate in class action lawsuits.

10. ENTIRE AGREEMENT

These Terms, along with our Privacy Policy, constitute the entire agreement between you and FixLancers regarding your use of the platform.

CUSTOMER TERMS OF USE

FixLancers is a platform designed to help you connect with independent service providers in your area.

1. All Service Providers are independent contractors who operate their own services — they are not employees or agents of FixLancers.

2. You will communicate directly with the Service Provider to coordinate your service needs.

3. If any changes, cancellations, or refund requests arise, your service provider will work with you directly to resolve them.

4. While FixLancers does not manage individual agreements, we’re happy to assist with communication if needed to help ensure a smooth experience.

5. Your contact information remains private and is only shared after mutual agreement to proceed.

6. To help protect both customers and providers, all payments should be processed securely through the FixLancers platform. This ensures safe handling of funds and helps avoid misunderstandings.

SERVICE PROVIDER / PROFESSIONAL TERMS OF USE

We’re excited to support your growth as a trusted Service Provider / Professional on FixLancers!

1. FixLancers connects you with local customers through our Platform, but you remain an independent contractor, not an employee or agent of FixLancers.

2. You are fully responsible for communicating, quoting, and completing the job directly with the customer.

3. We are placing our trust in you to treat every customer with professionalism, honesty, and respect.

4. We also trust you to process all payments through the FixLancers platform to ensure transparency and fairness.

5. If a customer requests a change, cancellation, or refund, please work with them directly to resolve it.

6. FixLancers does not manage individual service terms, but we’re here to assist with communication if needed.

7. Customer contact details are shared only after both sides confirm the job to protect privacy.
